What is a DUI?


The difference between a DUI and DWI can get confusing as the terminology usage varies from state to state. The acronyms mean 'driving under the influence' and 'driving while intoxicated,' or 'driving while impaired. Depending on where you are, one is primarily meant to apply to alcohol use, while the other can used for other illicit substances or even medications that have been lawfully prescribed by a doctor.

When Can You Be Charged with a DUI or DWI?


If an officer has a reason to suspect that you are driving under the influence, they can issue a BAC test, or blood alcohol content. The legal limit for each state is .08% in addition to a zero tolerance policy for drivers 16-21. 


Penalties will compound if you reach an enhanced BAC level, which is typically around twice the previously mentioned legal limit. 


California also complies with an "Implied Consent" law, which means if you are operating a vehicle, then you are deemed to have already give your consent to undergo a BAC test if an officer chooses to conduct one. Failure to comply can result in automatic penalties.

WHAT IS THE PUNISHMENT FOR A DUI OR DWI?


The codes for sentencing a DUI or DWI vary greatly by location, severity of the crime, and the number of times you've been convicted as an offender.


For example, a first-time offender who just fails a BAC test may be able to plead to fines and a likely temporary license suspension. Whereas someone who is heavily intoxicated will face enhanced penalties, meaning bigger fines, longer suspensions, and possible jail time.
